GENERAL TERMS AND CONDITIONS
PREAMBLE
These Conditions are issued by Good Times Entertainment Limited, the organiser and producer of the Festival (hereinafter the “Festival Organiser” or “Organiser”). They govern all agreements relating to the purchase and/or use of Festival Products and Services, including admission tickets, packages, access credentials, and any related offerings provided through Official Sales Channels.
By purchasing, accessing, or using any Festival Product or Service, or by attending the Festival in any capacity, You acknowledge and agree to be bound by these Conditions, together with any additional policies, rules, or instructions communicated by the Festival Organiser.
1. DEFINITIONS
For the purposes of these Conditions, the following terms shall have the meanings set out below:
1.1 “Agreement” means these Terms and Conditions, together with any annexes, schedules, or policies incorporated by reference, governing the relationship between the Festival Organiser and the Festival Visitor.
1.2 ‘Festival’ means the Blankets & Wine festival and any associated activities, programmes, or side events organised under its brand, identity, or official channels.
1.3 “Festival Organiser” or “Organiser” means GoodTimes Entertainement Limited, its officers, employees, authorised agents, partners, and contractors, responsible for the overall management, production, and control of the Festival.
1.4 “Festival Visitor”, “Visitor”, “Festival Attendee”, “Participants” or “Attendee” means any person who attends or participates in the Festival, including but not limited to ticket holders, performers, accredited professionals, staff, volunteers, vendors, contractors, sponsors, partners, and invited guests.
1.5 “Festival Site” means the designated grounds, venues, and facilities where the Festival is held, including entry points, stages, performance areas, food and beverage zones, rest areas, sanitary facilities, emergency exits, and any ancillary spaces under the control of the Organiser.
1.6 “Access Credential” means the authorised proof of entry issued by the Festival Organiser to a Festival Visitor. Access Credentials may include wristbands, badges, electronic passes, or any other device as determined by the Organiser. They are personal, non-transferable, and grant entry only to those areas and services for which they are valid.
1.7 “Ticket” means a valid proof of purchase granting entry to the Festival, issued exclusively through Official Sales Channels. Ticket categories and entitlements shall be communicated on the Festival’s official website.
1.8 “Refund” means the reimbursement of amounts paid for a Ticket where the Festival is cancelled in its entirety and cannot be rescheduled. Refunds shall not apply to partial programme modifications, weather-related adjustments, line-up changes, or other events outside the Organiser’s reasonable control.
1.9 “Cancellation” means the full withdrawal of a scheduled Festival edition by the Organiser. In such an event, the Organiser shall publish the applicable refund process and timelines.
1.10 “Programme” means the schedule of performances, events, workshops, exhibitions, or activities forming part of the Festival, whether published in advance or updated during the Festival. The Organiser reserves the right to amend the Programme at its discretion.
1.11 “Official Sales Channels” means the authorised platforms and agents designated by the Organiser for the sale and distribution of Festival Tickets and Access Credentials, including the Festival’s official website and approved ticketing partners.
1.12 “Safety Rules” means the health, safety, and security protocols communicated by the Organiser, whether published in writing, displayed at the Festival Site, or announced by staff or security personnel.
1.13 “Prohibited Items” means any item that is unlawful, hazardous, or restricted under the Organiser’s policies, including but not limited to weapons, controlled substances, fireworks, glass containers, unauthorised recording equipment, drones, or items deemed unsafe by the Organiser or security personnel.
1.14 “Vendor” means any authorised third party engaged in the provision of goods or services at the Festival Site, including food, beverages, merchandise, and other commercial offerings.
1.15 “Supplier” means any company, service provider, or individual engaged by the Organiser to provide equipment, logistics, materials, or other support necessary for the operation of the Festival.
1.16 “Performer or Artist” means any artist, musician, speaker, exhibitor, or participant contracted or invited by the Organiser to provide entertainment, performance, or engagement at the Festival.
1.17 “Sponsor or Partner” means any corporate or individual entity that provides financial or material support to the Festival under a sponsorship or partnership arrangement with the Organiser.
1.18 “Volunteer” means an individual engaged by the Organiser to assist with Festival operations, who is not employed under a formal employment contract but contributes time and service under agreed terms.
1.19 “Staff” means all individuals employed or formally contracted by the Organiser to perform administrative, operational, or support duties for the Festival.
1.20 “Crew” means the technical, production, and backstage personnel engaged by the Organiser or its suppliers to deliver the staging, sound, lighting, and operational execution of the Festival.
1.21 “Media/Press” means accredited journalists, photographers, broadcasters, and representatives of media organisations granted access by the Organiser to cover the Festival.
1.22 “Consent” means the freely given, informed, and unambiguous indication by which a Festival Visitor or Attendee agrees to the processing of their personal data, the use of their image or likeness in recordings, or other specified purposes, consistent with applicable law and the Organiser’s Data Protection Policy. For the avoidance of doubt, the purchase of a ticket to the Festival shall be deemed to constitute such consent in accordance with these Terms and the Organiser’s Data Protection Policy.
1.23 “Force Majeure” means any event or circumstance beyond the reasonable control of the Organiser that prevents or materially hinders the performance of its obligations, including but not limited to natural disasters, acts of terrorism, epidemics, government restrictions, or technical failures.
1.24 “Applicable Law” means all statutes, regulations, guidelines, and rules of the Republic of Kenya or any other relevant jurisdiction that govern the Festival, the Organiser, or the conduct of Festival Visitors.
1.25 “Data Protection Policy” means the policies adopted by the Organiser in compliance with applicable data protection and privacy laws, governing the collection, use, storage, and sharing of personal data of Festival Visitors or attendees.
1.26 “Personal Data” means any information relating to an identified or identifiable Festival Visitor, processed in accordance with applicable data protection laws and the Organiser’s Privacy Statement.
1.27 “Security Personnel” means the authorised staff or contracted security services engaged by the Organiser to ensure order, enforce Safety Rules, and protect Festival Visitors and property within the Festival Site.
1.28 “Emergency Services” means the medical, fire, evacuation, or other crisis response services engaged by or available at the Festival Site to respond to incidents, emergencies, or threats to safety.
1.29. “Children/Minors” means any person below the age of eighteen (18) years, in accordance with applicable laws.
2. SCOPE OF POLICY APPLICATION
2.1 APPLICATION
These Conditions apply to all persons who in any manner participate in or seek access to the Festival, including without limitation:
- Ticket holders and guests (hereinafter “Attendees,” “Holders,” or “Visitors”);
- Performing and non-performing artists;
- Volunteers, staff, crew, and contractors;
- Vendors, service providers, and their personnel; and
- Any other individual or entity granted admission by the Festival Organiser.
For the avoidance of doubt, these Conditions form part of the binding contract between the Festival Organiser and any party contracting with or granted admission by the Organiser. By so contracting or seeking admission, such party shall be deemed to have done so voluntarily and of their own free will, and to have accepted these Conditions in their entirety.
The Conditions govern all activities, rights, and obligations connected to the Festival and its official pre-events, after-events, partner events, live-streamed content, and any activity held on Festival sites or affiliated locations.
2.2 Tickets
2.2.1 Eligibility and Requirement of Tickets
(a) Every person aged eighteen (18) years and above must possess a valid Ticket to gain entry into the Festival Site and may be required to provide official identification upon entry.
(b) Persons under the age of eighteen (18) years (“Minors”) shall only be admitted if accompanied at all times by a parent, legal guardian, or responsible adult relative who is at least eighteen (18) years of age and in possession of a valid Ticket. Proof of age may be requested for both the Minor and the accompanying adult at the point of entry or at any time within the Festival Site.
(c) All Minors shall require a valid Minor’s Ticket or credential issued for record and identification purposes. Minors shall only be permitted entry into designated family zones, subject to the following:
- Children aged five (5) to twelve (12) years shall only be admitted on a valid Minor’s Ticket and must remain within the family zone accompanied by a responsible adult.
- Persons aged twelve (12) to sixteen (16) years must also hold a valid Minor’s Ticket, remain within the family zone, and be accompanied by a responsible adult.
- Persons aged sixteen (16) to seventeen (17) years must hold a valid Minor’s Ticket, be accompanied by a responsible adult, and remain within the family zone, with no access to prohibited areas or items.
Failure to present or obtain a valid Minor’s Ticket or credential may result in denial of entry for the Minor, and no refund shall be due in such circumstances.
(d) Any adult accompanying a Minor shall assume full and sole responsibility for the Minor, including their conduct, welfare, and compliance with these Conditions. The adult shall further indemnify and hold harmless the Festival Organiser, its officers, staff, and contractors against any claim, liability, damage, or loss arising from or in connection with the Minor’s presence at the Festival.
(e) The Festival Organiser shall take all reasonable measures to ensure that Minors remain within the designated family zones and are restricted from accessing prohibited items or areas. However, ultimate responsibility remains with the accompanying adult.
(f) The Festival Organiser reserves the right, at its sole discretion, to:
- vary or amend the minimum age of admission before any Festival;
- refuse admission or remove any person (adult or Minor) for breach of these Conditions or for any reason deemed necessary to protect the safety, security, or integrity of the Festival.
2.2.2 Official Sales Channels
(a) Tickets, Packages, and other admission credentials shall be sold exclusively via the Festival’s Official Sales Channels as designated and communicated by the Festival Organiser.
(b) Tickets purchased from unauthorised platforms, resellers, or third parties shall be deemed invalid. The Festival Organiser shall not be liable to confirm, exchange, refund, or otherwise validate such tickets. Any risk of loss rests solely with the purchaser.
2.2.3 Ticket Presentation and Validation
(a) Tickets must be presented upon arrival, in physical or electronic form, and must be readable and valid for entry.
(b) Lost, stolen, duplicated, tampered, or unreadable tickets shall not be honoured, replaced, or refunded.
2.2.4 Personalisation and Registration
(a) Each Ticket shall be registered in the name of the Attendee. The Festival Organiser reserves the right to require valid identification (passport, national ID, or equivalent) at any time.
(b) A Ticket is strictly personal and non-transferable once registered. Any unauthorised resale, attempted resale, or transfer shall entitle the Festival Organiser to cancel the Ticket without refund.
2.2.5 Ticket Exchange for Festival Bracelets
(a) Admission to the Festival Site is granted exclusively through the possession and wearing of an official Festival Bracelet, which is issued upon exchange of a valid Ticket at the designated entry point.
(b) The type of Bracelet issued shall correspond to the type of Ticket purchased (e.g., but not limited to General Admission, VIP, Artist, Crew, Vendor, Staff, Volunteer).
(c) Bracelets are strictly personal, non-transferable, and must be worn securely around the wrist at all times. Damaged, tampered, or lost Bracelets shall not be replaced.
2.2.6 Ticket Revocation
The Festival Organiser may revoke any Ticket, deny entry, or eject the Holder for violation of these Conditions, facility rules, unlawful activity, misconduct, or failure to comply with registration or verification requirements.
2.2.7 Refunds, Cancellations, and Transfers
(a) All Ticket sales are final. No refunds shall be provided except if the Festival is cancelled by the Organiser for reasons other than Force Majeure.
(b) Where cancellation is initiated by the Holder, no refunds shall be made.
(c) If the Festival is cancelled or rescheduled, Ticket Holders shall be notified promptly. Tickets may be transferred to a rescheduled date or another Festival within twelve (12) months. Refunds shall only be issued where cancellation is due solely to the Organiser and not to Force Majeure.
(d) The Organiser shall not be responsible for incidental expenses or consequential losses incurred by the Holder, including but not limited to accommodation, travel, or subsistence costs.
2.2.8 Programme Changes
The Holder acknowledges that Blankets & Wine provides the most current information available at the time of sale, but the Festival programme, line-up, or content may change beyond the Organiser’s control. The Organiser reserves the right to make reasonable changes without penalty. In such cases, no refunds, partial refunds, or alternative compensation shall be due.
3. ASSUMPTION OF RISK AND WAIVER.
3.1 Assumption of Risk
(a) By purchasing a Ticket, accepting Accreditation, or entering the Festival Site, each Participant (including but not limited to Attendees, Artists, Crew, Vendors, Contractors, Staff, Media, Partners, and Guests) acknowledges that attendance and participation are voluntary and may involve certain risks.
(b) Such risks include, without limitation: personal injury, illness, disability, or death; damage to or theft of property; exposure to amplified sound, lighting effects (including strobe or similar), varying weather conditions, and large crowds; as well as risks associated with participation in optional Festival experiences (such as VIP lounges, family/children’s zones, art installations, interactive spaces, or hospitality services).
(c) Participants accept and assume these risks as a condition of admission and agree to take full responsibility for their own safety, conduct, and property while within the Festival Site.
3.2 Waiver and Release of Liability
To the fullest extent permitted by law, Visitors and Attendees hereby waive, release, and discharge the Festival Organiser, its officers, directors, affiliates, employees, agents, contractors, sponsors, and partners (“Released Parties”) from any and all claims, demands, causes of action, damages, losses, or expenses arising from or related to attendance at or participation in the Festival, whether occurring before, during, or after the Festival.
3.3 Survival
These risk and waiver provisions survive the conclusion of the Festival and remain enforceable against Participants for any claims arising out of their attendance or participation.
4. FORCE MAJEURE
4.1 In the event the Festival is cancelled, rescheduled, delayed, interrupted, or otherwise adversely affected due to Force Majeure, the Festival Organiser shall not be liable for any refund, compensation, damages, or costs incurred by any Participant, save as communicated by the event organisers .
4.2 The Festival Organiser reserves the right, in its sole discretion, to reschedule the Festival or to offer alternative arrangements within twelve (12) months of the original scheduled dates. Such rescheduling or alternative arrangement shall discharge the Organiser from any further liability.
5. CANCELLATION AND POSTPONEMENT
5.1 In the event of cancellation or postponement of the Festival by the Organiser for reasons other than Force Majeure, Ticket Holders shall be entitled to a refund or transfer in respect of the purchased Festival Products and/or Services, subject to the refund procedures and any applicable Refund Fee.
5.2 Ticket Holders shall not be entitled to compensation for any consequential, incidental, indirect, or punitive damages (including, without limitation, travel, accommodation, subsistence, or opportunity costs).
5.3 Where Festival Products and/or Services have been purchased as part of a larger sponsorship, partnership, or collaboration agreement, the cancellation and postponement provisions in that agreement shall prevail over this Clause 5.
6. INDEMNIFICATION
6.1 By Ticket Holders and Attendees:
Each Ticket Holder and Attendee shall indemnify, defend, and hold harmless the Festival Organiser, its officers, employees, agents, affiliates, contractors, and all Released Parties from and against any and all claims, demands, actions, proceedings, liabilities, damages, losses, costs, or expenses (including without limitation reasonable legal fees and enforcement costs) arising directly or indirectly out of or in connection with:
- their attendance at, entry into, or participation in the Festival;
- their acts, omissions, misconduct, or negligence;
- any damage, loss, or harm caused to the Festival Site, venue, equipment, installations, or set-up;
- any incident, damage, or liability arising from the presence or conduct of Minors under their care, supervision, or control; and
- any damage, loss, or liability caused by their vehicles or property within or in connection with the Festival.
6.2 By Artists, Vendors, Contractors, and Service Providers:
Each Artist, Vendor, Contractor, Service Provider, or their personnel engaged at the Festival shall indemnify, defend, and hold harmless the Festival Organiser, its officers, employees, agents, affiliates, contractors, and all Released Parties from and against any and all claims, demands, actions, proceedings, liabilities, damages, losses, costs, or expenses (including without limitation reasonable legal fees and enforcement costs) arising out of or in connection with:
- their acts, omissions, misconduct, or negligence;
- any breach of contract, representation, or undertaking with the Organiser;
- any unauthorised collection, processing, or use of data or intellectual property without the express written licence of the Organiser;
- any destruction, damage, or interference with stages, equipment, or Festival infrastructure; and
- any injury, harm, or loss occasioned to any person, attendee, or property within or in connection with the Festival.
6.3 Standard of Care and Liability:
The Festival Organiser shall take all reasonable steps to ensure the Festival is operated in a safe, secure, and organised manner. Notwithstanding the foregoing, liability for any claim, damage, loss, or harm shall rest solely with the individual Ticket Holder, Attendee, Artist, Vendor, Contractor, Service Provider, or other relevant party responsible for the act, omission, or event giving rise to such liability, and not with the Festival Organiser or the Released Parties.
7. INSURANCE
7.1 All Artists, Vendors, Contractors, and Service Providers shall, at their own cost, maintain and keep in force adequate insurance coverage appropriate to their participation in the Festival, including but not limited to public liability insurance, workers’ compensation, and property insurance.
7.2 Proof of such coverage shall be provided to the Festival Organiser upon request. Failure to provide proof of adequate insurance may result in denial of access to the Festival Site or termination of the relevant engagement, without liability to the Festival Organiser.
7.3 The Festival Organiser shall not be liable for any uninsured risks borne by Artists, Vendors, Contractors, Service Providers, or other Participants.
8. RESTRICTED ACCESS, WAIVERS, AND RELEASES
8.1 Holders shall not enter any restricted or unauthorized areas (including backstage, technical zones, and staff-only areas) unless expressly authorized by the Organizer.
8.2 Special zones, including but not limited to VIP areas, children’s zones, family zones, and experiential installations, may require additional waivers or acknowledgments prior to entry. By entering such areas, the Holder assumes all associated risks and agrees to release and hold harmless the Organizer from any claims arising from such participation.
8.3 Any Holder interfering with performances, technical operations, or security protocols shall be removed from the Event without refund and may be subject to permanent exclusion from future Events.
9. PUBLIC HEALTH AND SAFETY COMPLIANCE
9.1 All Holders must comply with applicable health and safety laws, directives, and venue protocols, including public health advisories, security screenings, and reasonable instructions from the Organizer or authorized personnel.
9.2 The Organizer reserves the right to refuse entry, deny access, or eject any Holder who fails to comply with such measures, without liability for refund or compensation.
10. MEDICAL ASSISTANCE
10.1 Each Holder remains primarily responsible for their own health and safety. It is advisable to identify first aid stations upon entry.
10.2 Medical or first aid staff may be available at the Event. In case of urgent need, Holders should promptly contact an identified staff member or security officer.
10.3 By attending, the Holder acknowledges and agrees that the Organizer does not assume a duty of care for the provision of medical services and shall not be liable for the acts or omissions of medical staff, except as required by law.
11. MOBILE PHONE AND NETWORK SERVICES
11.1 Due to high network demand, mobile phone coverage may be limited. The Organizer does not guarantee continuous, reliable, or uninterrupted mobile services and shall not be liable for any loss, damages, or inconvenience caused by network failures or limitations.
12. LIMITATION OF LIABILITY
12.1 Attendance at the Festival is entirely at the Attendee’s own risk. The Organizer shall not be liable for any:
(a) personal injury, illness, or death sustained during or in connection with the Festival;
(b) damage to, loss of, or theft of any personal property, belongings, or equipment; or
(c) incidental, indirect, or consequential losses, expenses, or damages (including but not limited to travel, accommodation, subsistence, and ancillary services),
howsoever arising, whether before, during, or after the Festival.
12.2 The Organizer shall make reasonable efforts to ensure the safety, security, and proper management of the Festival; however, all Attendees, vendors, artists, contractors, and other participants assume full responsibility for their own health, safety, and property.
12.3 All Attendees are strongly advised to obtain and maintain their own insurance coverage, including but not limited to medical, travel, and property insurance, in respect of any risks associated with attending the Festival.
13. RESPONSIBILITIES OF HOLDERS
13.1 Holders are responsible for their own health, safety, and property at all times. The existence of Event security shall not be construed as a guarantee of safety.
13.2 Holders are responsible for assessing whether sound levels or other conditions are suitable for them and any accompanying minors. The Organizer accepts no liability for hearing damage or other health impacts caused by Event conditions.
13.3 Non-attendance of an Event, whether due to illness, emergency, or inability to attend a rescheduled Event, does not entitle the Holder to a refund unless expressly provided herein.
14. RULES OF CONDUCT
14.1 Holders must comply with generally accepted standards of public conduct and the specific rules of the Festival, including the below directives as well as those describes in Annex 2.0 but not limited to:
- not engaging in or inciting violence, hate speech, or unlawful acts;
- using only designated facilities (toilets, waste disposal points) appropriately;
- not attending if suffering from a contagious disease;
- not engaging in crowd surfing, open fires, or unauthorized commercial activities.
14.2 Breach of these rules may result in removal from the Event without refund.
15. REMOVAL AND EXCLUSION
15.1 The Organizer may remove or refuse admission to any Holder who breaches these Conditions or poses a risk to safety, order, or the reputation of the Festival.
15.2 Removed Holders shall not be entitled to a refund. The Organizer may also impose bans from future Events.
16. PHOTOGRAPHY, VIDEO, AND IMAGE RIGHTS
16.1 By purchasing a Ticket, registering, or otherwise attending the Festival, Attendees, vendors, artists, contractors, service providers, and all other participants (“Participants”) acknowledge and agree that the Festival will involve photography, filming, and audio-visual recording. Entry into the Festival grounds shall constitute express and continuing consent to being photographed, filmed, recorded, and otherwise captured, whether individually or as part of a group or crowd, without any entitlement to compensation, subject only to any opt-out procedures laid out in these Terms and Conditions by the Organizer.
16.2 Participants grant the Organizer, together with its licensees and authorized representatives, the unrestricted, worldwide, transferable, sublicensable, and perpetual right to use, reproduce, adapt, distribute, publish, broadcast, and otherwise exploit their image, voice, likeness, or performance in any media now known or hereafter developed, including without limitation live streaming, television, film, radio, digital platforms, social media, promotional campaigns, press coverage, and archival materials, strictly for purposes connected with the Festival, including but not limited to marketing, sponsorship, promotional content, or related productions. All intellectual property rights in such materials shall vest exclusively in the Organizer.
16.3 Pre-Festival Opt-Out: Participants may withdraw consent for the use of their identifiable image only by submitting a written request to info@goodtimesafrica.com at least fourteen (14) days prior to the Festival. Such request must include a recent passport-size photograph of the Participant and a valid copy of their official identification document. Upon arrival at the Festival, the Participant shall be solely responsible for notifying the Organizer’s designated staff of their opt-out status and presenting proof of the same. The Organizer shall thereafter provide reasonable guidance or direction to assist the Participant in avoiding photography or filming zones; however, the ultimate responsibility for ensuring that they are not captured rests with the Participant.
(b) Post-Festival Opt-Out: Participants may object to the continued use of a specific identifiable image only by submitting a written request to info@goodtimesafrica.com, accompanied by (i) a clear description of the image or recording objected to, (ii) the exact location (URL, platform, or channel) where it appears, (iii) the date and context of its capture (if known), and (iv) evidence reasonably establishing that the image is of the Participant. The Organizer shall, within twenty-one (21) days, review the objection and determine its validity at its sole discretion. Where the objection is accepted, the Organizer shall, within seven (7) days thereafter, cease further use of the specific image and use reasonable efforts to remove the material from its directly controlled platforms.
(c) Limitation of Liability: The Organizer shall not be liable for, nor undertake any obligation to remove, copies, reproductions, redistributions, or republications of the material that have already been lawfully created, captured, distributed, or published by third parties outside its control, nor for incidental or background appearances of Participants in group or crowd shots. Participants acknowledge that complete exclusion from all recordings cannot be guaranteed.
17. LIMITATION OF LIABILITY
17.1 By attending the Festival, each Attendee acknowledges and accepts that participation involves inherent risks, including but not limited to crowding, loud music, strobe lighting, outdoor conditions, weather changes, restricted movement, and interaction with third parties. Attendees assume full responsibility for their own health, safety, property, and conduct while at the Festival.
17.2 To the maximum extent permitted by law, the Organizer, its affiliates, officers, directors, employees, agents, and contractors shall not be liable for:
(a) any personal injury, illness, or health-related issues, except where the Organizer has failed to take reasonable and proportionate safety measures consistent with applicable law;
(b) any loss of or damage to property, including theft, misplacement, or breakage of personal belongings, whether occurring inside or outside the Festival venue;
(c) any indirect, incidental, special, or consequential losses, including but not limited to travel, accommodation, subsistence, loss of enjoyment, or ancillary services;
(d) any loss of connectivity or network interruptions affecting mobile or internet services, whether caused by the venue’s infrastructure, third-party service providers, or security protocols;
(e) any loss, delay, or failure in performance arising from circumstances beyond the Organizer’s reasonable control, including but not limited to force majeure events as set out in Clause 4.
17.3 While liability is limited as above, the Organizer shall take reasonable steps to provide a safe and secure environment at the Festival, including engaging professional security, emergency response services, and risk management protocols.
17.4 Attendees are responsible for safeguarding their own property, arranging appropriate personal insurance, and exercising care and caution at all times while at the Festival. Parents, guardians, or supervisors accompanying minors shall be fully responsible for them.
17.5 Where liability of the Organizer cannot lawfully be excluded, the Organizer’s aggregate liability to any Attendee (whether in contract, tort, negligence, or otherwise) shall be strictly limited to the face value of the Ticket purchased for the Festival.
18. DATA PROTECTION & PRIVACY
18.1 The Organizer may collect, process, and store personal information of Attendees for purposes connected with the purchase of Tickets, access to the Festival, safety and security, communication, and compliance with applicable laws.
18.2 Personal data may be used to:
(a) administer Ticket sales and entry to the Festival;
(b) communicate updates, safety notices, or other relevant information to Attendees;
(c) comply with statutory or regulatory obligations;
(d) improve the Festival experience, including through feedback and analysis.
18.3 By purchasing a Ticket or Festival Product, Attendees are deemed to have provided consent to the collection, processing, and use of their personal information in accordance with these Conditions and the Organizer’s Privacy Policy.
18.4 The Organizer shall implement appropriate technical and organizational measures to protect personal information against unauthorized access, loss, or misuse, and shall not sell or transfer personal data to third parties except as necessary for Festival operations or as required by law.
18.5 Attendees shall have the right, at any time, to request from the Organizer:
(a) access to the personal data held about them;
(b) rectification of any inaccurate or incomplete data;
(c) restriction of processing or objection to certain uses; and/or
(d) erasure of their data where legally permissible.
The Organizer will provide confirmation of the data held and any requested corrections, restrictions, or deletions within thirty (30) days of receipt of such request. Requests shall be submitted to info@goodtimesafrica.com. 18.5 The Organizer shall take reasonable steps to handle personal data in accordance with the Data Protection Act but shall not be liable for:
(a) incidental inclusion of a Participant’s image in crowd or atmospheric shots; or
(b) the distribution or use of images, recordings, or other media by third parties not authorized by the Organizer.
- AMICABLE SETTLEMENT & DISPUTE RESOLUTION
19.1 The Parties shall, in the first instance, make every reasonable effort to resolve amicably any dispute, controversy, or claim arising out of or in connection with this Agreement. Such efforts at amicable settlement shall be undertaken within thirty (30) days from the date either Party notifies the other of the existence of a dispute.
19.2 If the Parties are unable to resolve the dispute within the thirty (30) day period, either Party may refer the matter to mediation, to be undertaken at their own cost or as otherwise agreed.
19.3 No Party shall institute court proceedings in respect of any dispute arising from this Agreement unless a period of sixty (60) days of attempting to resolve the matter amicably and through mediation has elapsed, except where it is necessary to seek urgent injunctive or conservatory relief.
20. LEGALLY BINDING EFFECT
20.1 The purchase, possession, or use of a ticket constitutes acceptance of these Terms and Conditions.
20.2 Where a person purchases a ticket on behalf of another Attendee, that purchaser is deemed to have communicated these Terms to the Attendee, and the Attendee shall be bound accordingly.
20.3 The Organizer reserves the right to amend these Terms. Updated versions shall be published on the official website and shall be binding from the date of publication.
21. MISCELLANEOUS
21.1 These Terms constitute the full and binding agreement between the Holder and the Organizer in respect of the Event and supersede any prior discussions, agreements, or understandings, whether oral or written.
21.2 If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain effective, and the invalid provision shall be replaced with one that reflects as closely as possible the original intent.
21.3 No failure or delay by the Organizer in enforcing any provision shall operate as a waiver. Any waiver must be expressly made in writing.
21.4 The Organizer may assign or transfer its rights and obligations under these Terms without notice. The Holder may not assign or transfer their rights or obligations without the Organizer’s prior written consent.
21.5 All notices or communications in relation to these Terms must be made in writing and addressed to the Organizer at info@goodtimesafrica.com.
21.6 Provisions relating to risk assumption, limitation of liability, indemnification, intellectual property, image rights, and dispute resolution shall survive termination or expiration of these Terms.
21.7 By purchasing a Ticket, registering as an Attendee, or entering the Festival Site, the Holder expressly accepts and agrees to comply with these Terms and related policies as published at www.blanketsandwine.com, or as otherwise communicated by the Festival Organizer through www.blanketsandwine.com. - Final Provisions
These Terms and Conditions are binding upon all Participants and are enforceable to the fullest extent permitted by law. By purchasing a Ticket, registering, or entering the Festival Site, each Participant confirms that they have read, understood, and agreed to be bound by these Terms. The Organiser reserves the right to amend or update these Terms at any time, and such amendments shall take effect upon publication on www.blanketsandwine.com or being directly communicated to participants, holders or attendees.

ANNEX 1.0: ACCESS AND GUIDELINES TO THE FESTIVAL
The Festival shall open and close at times communicated by the Organizer, which may vary across different days and will be displayed on official channels, signage at the Festival site, and through any other communication platforms the Organizer may adopt. Attendees are expected to familiarize themselves with and adhere strictly to the published opening and closing times. Entry into the Festival grounds is permitted only during the times indicated by the Organizer, and re-entry is subject to the Organizer’s directions. Once the gates are closed for the day, no further admissions shall be allowed, even if a valid ticket is held, unless specifically permitted by the Organizer. All persons entering the Festival grounds agree to comply with all safety, security, and operational procedures set by the Organizer, including those communicated at entry, through official signage, or verbally by Festival staff and security.
The Festival is designed to run according to a carefully curated programme. While every effort shall be made to deliver the announced line-up and performances at the times communicated, circumstances may arise beyond the Organizer’s control, including but not limited to adverse weather, technical challenges, safety considerations, or artist-related contingencies. In such cases, the Organizer reserves the right to make necessary adjustments to the programme, including but not limited to changes in performance times, stage allocations, or cancellations. Entry tickets remain valid in all such circumstances, and no refunds or exchanges will be provided unless expressly communicated by the Organizer. Attendees are advised to check official channels regularly before and during the Festival for any updates.
All attendees must follow directional signage and respect crowd management instructions issued by Festival staff at all times. This includes guidance on entry and exit routes, stage access, designated areas for food, beverages, rest, medical assistance, and emergency assembly points. Signage will be prominently displayed across the Festival site, and attendees must act responsibly to ensure their safety and the safety of others. Failure to follow instructions may result in removal from the Festival grounds without refund. The Organizer may, at its discretion, restrict access to certain areas of the Festival site, including backstage or artist-only areas, VIP sections, hospitality tents, or technical zones. Such areas shall be clearly marked and unauthorized access is strictly prohibited.
The Festival grounds are designed to accommodate large numbers of attendees. The Organizer may temporarily restrict access to certain stages or sections of the Festival when capacity is reached in the interest of health, safety, and security. Attendees are requested to respect such restrictions and to move to alternative stages or entertainment areas as guided by Festival staff. While the Organizer will endeavor to ensure that all attendees enjoy the Festival experience, no guarantee is made that an attendee will be able to view a particular performance from a particular location. Attendees are encouraged to plan their day accordingly and arrive at stages in good time for acts they particularly wish to see.
The Festival programme may also include non-musical performances, installations, talks, or other cultural and social experiences curated by the Organizer. These activities shall form an integral part of the Festival, and attendees are encouraged to participate. Access to such activities may be subject to additional conditions, including age restrictions or space limitations, and shall be communicated in advance or on-site.
The Organizer reserves the right to close stages, tents, or sections of the Festival grounds earlier than scheduled in case of security concerns, technical issues, or in compliance with instructions from authorities. In such instances, no refund or exchange will be due, and tickets shall remain valid for the Festival as a whole. If the Festival is interrupted for a short duration due to safety or security reasons, the Organizer shall endeavor to resume the event as soon as practicable, if possible. Attendees are required to cooperate fully with instructions during any such interruption, including evacuations or temporary halts.
All times for opening, closing, and performances are approximate and subject to change without prior notice. The Organizer shall not be responsible for delays in the commencement of performances or for changes in the advertised running order. In the case of significant changes, announcements will be made on-site and through official communication channels. It is the responsibility of the attendee to remain informed about such changes.
Entry to the Festival site shall be conditional upon the possession of a valid Festival ticket and compliance with security checks at the gates. Attendees must carry identification and their ticket or wristband at all times and present them upon request by the Organizer’s staff or security. The Festival wristband or ticket is strictly personal and non-transferable once activated at the gates. Removal, tampering, or loss of the wristband may result in denial of access without refund.
In order to maintain an enjoyable and safe experience for all, attendees must respect all rules regarding noise, conduct, prohibited items, and restricted areas. Any person found to be in breach of these rules may be denied entry or removed from the Festival grounds without refund. The Organizer may, at its sole discretion, determine what constitutes unacceptable conduct, including but not limited to harassment, violence, unsafe behavior, vandalism, or the use of prohibited substances.
Attendees are responsible for making their own arrangements for travel, accommodation, and sustenance in connection with the Festival, unless expressly included in a specific Festival package purchased through authorized channels. The Organizer is not liable for incidental costs incurred in relation to the Festival, including but not limited to travel delays, accommodation cancellations, or other disruptions outside the Festival site.
Blankets & Wine is committed to providing a welcoming, inclusive, tolerant and safe environment for all attendees. Attendees are encouraged to look out for one another and to report any safety or security concerns to Festival staff or security personnel immediately. Medical and first aid services will be available on-site, and signage shall direct attendees to the nearest assistance points. The Organizer shall make reasonable efforts to provide accessibility for persons with disabilities, but attendees with specific needs are encouraged to contact the Organizer in advance of the Festival to ensure appropriate arrangements can be made.
The Festival is intended to be enjoyed responsibly, and attendees are reminded that the Festival environment is a shared space. Respect for fellow attendees, performers, staff, and the venue is expected at all times. Attendees acknowledge that the Festival may involve loud music, large crowds, and varying weather conditions, and they attend at their own risk subject to the Terms and Conditions.
ANNEX 2.0 : BLANKETS AND WINE FESTIVAL – HOUSE RULES
The following House Rules govern all persons entering and remaining at the Blankets & Wine Festival (“the Festival”). They are intended to safeguard the safety, security, and enjoyment of all participants while ensuring compliance with applicable laws and policies. By purchasing a ticket, accepting a Festival wristband, or entering the Festival grounds, each Festival Visitor agrees to comply fully with these Rules, as well as with any on-site directions from the Organiser, security teams, and relevant authorities. These Rules apply equally to all ticket holders, guests, and accredited persons.
1. Entry and Admission
Entry into the Festival is strictly controlled and subject to the following:
- Only persons holding a valid Festival ticket purchased through official channels will be admitted.
- Tickets and wristbands are personal, non-transferable, and non-refundable, unless explicitly communicated otherwise.
- Wristbands must be worn at all times and remain intact; tampering or removal invalidates entry.
- Visitors must carry valid government-issued identification and present it upon request for verification of age or identity.
- The Organiser reserves the right to deny entry for security reasons, non-compliance with rules, intoxication, or disruptive conduct.
- Re-entry is permitted only if wristbands remain intact and according to procedures determined by the Organiser.
The Festival Organiser may refuse access to Visitors who arrive outside communicated entry hours, even where a valid ticket is held.
2. Security and Safety Checks
To maintain a safe environment, all Visitors agree to undergo appropriate security procedures. These include:
- Bag inspections, personal searches, and scanning upon entry.
- Confiscation of prohibited items and denial of entry in cases of non-compliance.
- Cooperation with random checks during the Festival.
Prohibited items (non-exhaustive):
- Weapons, sharp objects, or items that may be used as weapons
- Illegal drugs, narcotics, or drug paraphernalia
- Glass bottles, cans, or containers
- Fireworks, explosives, or pyrotechnics
- Professional recording equipment, drones, or broadcasting devices without prior accreditation
- Food and drinks purchased outside the Festival (exceptions for medical or dietary needs with evidence)
All confiscated items will be disposed of; no safekeeping service is provided.
3. Behaviour on Site
The Festival seeks to promote respect, inclusivity, and enjoyment for all. Visitors, Artists, Staff, Crew, Partners, and all other participants must:
- Treat artists, staff, crew, and fellow attendees with courtesy and respect.
- Avoid any form of harassment, discrimination, violence, or abuse.
- Refrain from behaviour that threatens public safety or disrupts performances.
- Comply with signage, pathways, and restricted zones.
- Smoke only in designated areas.
- Consume alcohol responsibly; alcohol will not be served to persons under 18.
Strictly refrain from prohibited conduct, including but not limited to gambling, sexual harassment, sexual assault, or any other form of harassment, whether verbal, physical, or digital, by any individual (Attendee, Artist, Staff, Crew, Partner, or otherwise).
Any breach of these rules may result in immediate removal from the Festival Site, even without refund. Where such conduct constitutes a criminal offence, the Organiser shall cooperate fully with law enforcement and provide reasonable assistance in any investigation.
The Organiser shall, however, not be liable for the acts or omissions of Festival Visitors, Artists, Staff, Crew, or third parties. Responsibility for such conduct lies solely with the perpetrator.
4. Programme and Performances
The Organiser will communicate the Festival programme in advance through official channels and signage on-site. Visitors acknowledge that:
- The line-up, stage times, and sequence of performances may change for technical, operational, or safety reasons.
- Cancellations or modifications do not entitle Visitors to refunds unless expressly communicated by the Organiser.
- Stage access is subject to capacity limits, and admission to specific performances is not guaranteed.
5. Access Restrictions
The Festival grounds are divided into public, staff, and restricted access zones.
- Only accredited personnel may enter backstage, artist, and production areas.
- Entering restricted zones without authorisation is strictly prohibited and may result in removal.
- Access to certain stages or lounges may be limited by ticket category or wristband access rights.
6. Health, Safety, and Emergencies
- Visitors must follow all safety announcements, instructions from staff, and signage.
- Emergency exits and access ways must remain clear at all times.
- In case of evacuation, Visitors must move calmly to designated assembly points and follow official instructions.
- Medical services will be available throughout the Festival; Visitors are encouraged to seek immediate help in case of illness or injury.
- Visitors are responsible for their own health and wellbeing and are encouraged to hydrate, rest, and act responsibly.
7. Camping and Extended Stay (if introduced in future editions)
Although Blankets & Wine is primarily a day festival, provisions for camping may be introduced in the future. If applicable:
- Only designated camping grounds may be used.
- Check-in and check-out procedures will be communicated in advance.
- Fires, stoves, and cooking appliances are prohibited unless expressly authorised.
- Noise restrictions and quiet hours will apply.
- The Organiser reserves the right to inspect tents and camping spaces for compliance.
8. Environmental Responsibility
The Festival is committed to environmental sustainability. Visitors must:
- Dispose of waste in designated bins and recycling points.
- Avoid single-use plastics where possible and embrace reusable items.
- Refrain from littering, vandalism, or damaging Festival infrastructure or surrounding areas.
- Respect the natural environment, flora, and fauna.
Violations may lead to fines or removal from the Festival grounds.
9. Liability and Compliance
Attendance is at the Visitor’s own risk. The Organiser shall not be held liable for theft, property damage, or injury unless caused by proven gross negligence.Visitors are responsible for safeguarding their belongings.The Organiser will comply with applicable laws and requires all Visitors to do the same.Any person found breaching the law will be handed over to relevant authorities.
- Lost and Found
10.1 Festival Attendees are encouraged to report lost items immediately to designated Festival staff or the Lost and Found station.
10.2 Any items found must be handed over to the Lost and Found station without delay.
10.3 The Organiser will make reasonable efforts to safeguard found property during the Festival and will make periodic announcements regarding lost property. However, the Organiser does not assume responsibility for the safekeeping, damage, destruction, or loss of any items.
10.4 Items not claimed by the close of the Festival will be deemed abandoned. If retained beyond the Festival period, such retention shall be purely at the discretion of the Organiser, in good faith, and without creating any liability. By failing to collect an item, the Attendee expressly waives any claims against the Organiser in respect of its safekeeping, condition, or return.
11. Photography and Media
11.1 Personal photography and recording by Attendees may be permitted for private, non-commercial use only. Such permission is subject to restrictions imposed by the Organiser and may be withdrawn at any time, including for reasons of safety, security, or artist requirements. No Attendee has an absolute right to film or record at the Festival.
11.2 The use of professional photography, video, or audio equipment is strictly prohibited unless the holder has obtained prior written accreditation from the Organiser. Any unaccredited professional recordings shall be considered unauthorised and may be confiscated or deleted, and the holder may be removed from the Festival Site.
11.3 All official Festival recordings, including photography, video, and audio captured by or on behalf of the Organiser, remain the exclusive property of the Organiser. Such content may be used for promotion, media coverage, or archival purposes, without compensation to the Attendee.
11.4 By attending the Festival, each Attendee expressly consents to being photographed, filmed, or otherwise recorded for such purposes, as further provided under the Terms and Conditions and the Festival Privacy Policy.
12. Children and Minors
12.1 Children and Minors may attend the Festival subject to these Terms and any additional requirements imposed by the Organiser.
12.2 All Children and Minors must be accompanied at all times by a parent, legal guardian, or responsible adult who is at least eighteen (18) years of age and in possession of a valid Ticket. The accompanying adult shall remain fully responsible and liable for the conduct, safety, and welfare of the Child or Minor under their care.
12.3 Children and Minors shall be restricted to designated Family Zones and Children’s Zones within the Festival Site and shall not be permitted access to areas outside these zones unless expressly authorised by the Organiser.
12.4 The Organiser requires that all Children and Minors exit the Festival Site by 6:00 p.m. Should an accompanying adult elect to remain with a Child or Minor beyond this time, they do so entirely at their own risk and at the risk of the Child or Minor. While the Organiser will continue to maintain reasonable security measures within the Festival Site, the accompanying adult assumes sole responsibility for the Minor’s safety, supervision, and welfare during any extended stay.
12.5 Any breach of these conditions, including but not limited to access to prohibited areas, possession of restricted items, or disruptive or unsafe conduct by a Child, Minor, or their accompanying adult, may result in immediate removal of the Child or Minor and/or the accompanying adult from the Festival Site, without refund.
